Clearance Analysis and Clearance Opinions 

 

Clients that create an actual product or service are often concerned that they do not violate anyone else's patent. The first step in the clearance process is often utilizing a professional searcher to conduct a search for patents in the database of the United States Patent & Trademark Office for patents that may cover the product or service. Patent Ingenuity, P.C. then performs an analysis on the search results to determine if there is any concern.
 
 Depending on the analysis, Patent Ingenuity, P.C. may be able to provide an oral and/or written opinion. The opinion may be a (1) clearance opinion that the product or service does not infringe a patent; (2) invalidity opinion that the patent is invalid; or (3) a clearance and invalidity opinion.
